ALL PURCHASES FROM THIS WEBSITE ARE SUBJECT TO THE TERMS AND CONDITIONS SET FORTH HEREIN. PLEASE READ THIS SECTION FULLY BEFORE MAKING ANY PURCHASE ON THIS WEBSITE. BY MAKING A PURCHASE FROM THIS WEBSITE, YOU AGREE THAT YOU HAVE READ THE TERMS AND CONDITIONS AND AGREE TO BE BOUND THEREBY.

BOATING AND THE USE OF ANCHORS IS AN INHERENTLY DANGEROUS ACTIVITY. PURCHASER ASSUMES THE RISK OF ANY DAMAGES THAT MAY OCCUR TO PERSONS OR PROPERTY THROUGH THE USE OF ANY GRAPPLER ANCHOR.

Terms of Use. Grappler Anchors are intended for in-shore or near-shore use of anchoring boats only. Each size of Grappler Anchor is only meant for use with a specific length of boat. Specifications are found on the website. No Grappler Anchor is meant for use on any boat over forty (40) feet in length. Outsource Authority, Ltd. (OA) shall not be responsible for damage done to or by any anchor or boat through the incorrect, negligent, or careless use of an anchor or its accessories.

Limited Warranty. All Grappler Anchors come with a one (1) year limited warranty. If any anchor tine should break off, or become damaged beyond usage, outside of normal wear and tear, OA shall replace the entire anchor. Purchaser is responsible for shipping costs from OA’s warehouse to Purchaser. OA shall have the final decision as to what is “normal wear and tear”, and shall have the right to deny any replacement that it deems was necessitated by normal wear and tear or abnormal usage of the anchor.

Disclaimer of All Other Warranties. OA HEREBY DISCLAIMS AND EXCLUDES ANY IMPLIED WARRANTY OF MERCHANTABILITY OR IMPLIED WARRANTY FOR FITNESS FOR A PARTICULAR PURPOSE. EXCEPT FOR THE LIMITED WARRANTY CONTAINED ABOVE, OA DISCLAIMS ANY AND ALL OTHER WARRANTIES THAT COULD BE APPLIED TO “CONSUMERS” IN THE MAGNUSON-MOSS WARRANTY-FEDERAL TRADE COMISSION IMPROVEMENTS ACT. THESE EXCLUSIONS OF IMPLIED WARRANTIED DO NOT APPLY TO THE EXTENT PROHIBITED BY LAW.

Limitations of Liability. Purchaser hereby agrees that OA shall not be held liable for any damage caused by any use of a Grappler Anchor by Purchaser, or any third party under Purchaser’s supervision or control. Purchaser acknowledges that boating and the use of anchors is inherently dangerous, and agrees to hold harmless and not sue OA for any damages that may be caused to persons or property by the use of a Grappler Anchor.

Revisions of These Terms and Conditions. OA may revise these Terms and Conditions at any time and from time to time by updating this posting. You should visit this website from time to time to review the then current Terms and Conditions because they are binding on you. Choice of Law. These Terms and Conditions shall be governed in all respects by the laws of the State of Texas, without regard to any provisions thereof relating to conflicts of laws among different jurisdictions. Any and all disputes relating to this agreement shall be brought in state court located in Collin County, Texas.
